Terms of service

Last updated 15 October 2026

These terms govern your use of the Nenco platform at nenoise.com (the “Service”) operated by Northeast Noise Company (“Nenco”, “we”, “our”). By creating an account or uploading content, you agree to be bound by these terms. If you do not agree, please do not use the Service.

1. Eligibility

  • You must be at least 18 years old to use Nenco.
  • You must have the legal right to enter into a contract in your jurisdiction. If you register on behalf of a band or label, you confirm you have the authority to bind that entity.
  • You must provide accurate, current information during sign-up and KYC. Misrepresentation is grounds for immediate termination and forfeiture of unpaid earnings.

2. Your content, your rights

You retain full ownership of every recording, composition, image, and metadata you upload. Nothing in these terms transfers ownership of your music to Nenco.

By uploading content, you grant Nenco a non-exclusive, worldwide, royalty-free licence to reproduce, distribute, transmit, and sub-licence that content for the sole purpose of delivering it to streaming platforms and reporting the resulting royalties back to you. This licence terminates when you take a release down, with the carve-outs described in section 5 below.

3. Content rules

You may only upload material you own outright or have full clearance for. Specifically:

  • You must own (or have written permission for) the master recording rights.
  • You must have cleared all underlying composition rights (writers, publishers, samples, covers under statutory licence).
  • You must have model releases for every identifiable person in cover art or videos.
  • Collaborator royalty splits you enter must reflect the actual rights agreement among contributors. Misrepresenting splits is grounds for account termination and clawback.

You may not upload content that is infringing, defamatory, fraudulent, designed to manipulate streams, or otherwise unlawful. See the content policy for the full list of restrictions and the takedown process for rights holders.

4. Revenue and payouts

  • Nenco is free to register and free to distribute music. We do not charge an upfront fee or monthly subscription.
  • For self-serve artists releasing under the Northeast Noise Company imprint, Nenco retains 20% of net DSP revenue as it arrives. The remaining share, after applicable taxes and any collaborator splits you have configured, is credited to your account.
  • For labels onboarded via the contact-us flow, revenue terms are agreed in writing during onboarding and supersede the default 20% above. Nenco may agree a different share for an individual release in writing.
  • DSP royalty reports arrive with an industry-standard lag of approximately 3 months between the calendar month a stream occurs and the month it is reported.
  • Payouts are made via Razorpay (INR for Indian users; international transfers for global users). You must complete KYC before your first payout. Razorpay applies its own fees, which Nenco does not control.
  • We never auto-disburse funds. Each payout cycle is reviewed by a human before money moves. This is a discipline against bad data, not a delay tactic.
  • Unclaimed balances below the minimum payout threshold roll over to the next cycle.

5. Takedowns and termination

You may request a takedown of any release at any time from the dashboard. Every takedown costs ₹199, paid before the request is sent to the stores and non-refundable once sent. Full details and the process are in the refund + service delivery policy.

Some DSPs retain content in non-streaming contexts (e.g. user playlists) per their own policies. After takedown, the licence in section 2 narrows to what is needed to continue reporting and paying out trailing royalties for already-streamed content.

We may suspend or terminate your account if you:

  • Breach these terms or the content policy.
  • Provide false KYC data.
  • Engage in stream manipulation, fraud, or copyright infringement.
  • Become subject to legal proceedings that materially affect your ability to deliver clean rights to your content.

On termination, accrued and verified royalties remain payable. Forward-looking distribution ceases immediately.

6. AI-assisted features

Nenco offers optional AI assistance for metadata, release descriptions, and cover art variants. The outputs are starting points — you remain responsible for verifying that the final published content is accurate, non-infringing, and represents you correctly. We do not use your audio or unreleased content to train third-party AI models without your explicit consent.

7. Service availability

We work hard to keep the platform online but make no warranty of uninterrupted access. Scheduled maintenance and rare outages are part of running internet services. We do not promise that releases land on a specific date; DSP review times are outside our control.

8. Limitation of liability

To the maximum extent permitted by law, Nenco's aggregate liability for any claim arising from your use of the Service is limited to the revenue Nenco has retained from your account in the 12 months preceding the claim. We are not liable for indirect, consequential, or speculative damages (including lost opportunity, reputational harm, or future earnings).

9. Governing law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at Guwahati, Assam.

10. Changes to these terms

Nenco reserves the right to modify, amend, or replace these terms at any time, at its sole discretion, as the platform's operational, legal, or business requirements evolve. Material changes will be announced via email to your account address at least 14 days before they take effect. Non-material changes (typos, clarifications, contact details) may take effect immediately on publication. Continued use of the Service after the effective date constitutes acceptance of the updated terms. The “last updated” date at the top of this page is authoritative.
